Audience member sues drummer for tossed stick

Styx drummer, Todd Suchermann, is being sued by an attendee to one of their shows when a stick he tossed into the audience struck her and injured her. I don't know that this has ever happened before.

Drummers have been tossing sticks into audiences going back to the early days of jazz and rhythm music. I remember when I was still playing live I feared injuring someone and never threw a stick into the audience, though did often hand them out or very gently toss them to someone who was clearly waiting to catch it. If the audience was especially large and excited I would sign a box of sticks and hand them out after the show to the audience as they lingered around outside the venue.
 
I'd be shocked if the ticket didn't include language that said attendees enter at their own risk.
 
One can make a solid argument that when attending a concert one should assume that a drumstick will hit you with enough force to cause bleeding and injury. So, I fear legally the plaintiff has a case.

But if Rock and Roll hasn't already died, this is the proof it is now dead.

I was cleaning up some music/concert related shows on the DVR this past weekend and when watching the Red Hot Chili Peppers new album release show/concert, I was dumbfounded by the number of sticks Chad Smith was throwing into the audience. Numerous times almost in each and every song they played. I thought to myself, there is going to be an instance that one of this sticks really hurts someone................ Years ago you would think it was cool and shrug it off, these days .............................. you sue! :thumbsdown::thumbsdown:
